By accessing or using CentreWizard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

CentreWizard is a cloud-based childcare management platform provided by Bluegum Labs Pty Ltd. The Service includes features for centre management, educator tools, parent engagement, and compliance tracking designed specifically for Australian childcare centres.

3. User Accounts and Responsibilities

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account

3.2 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Upload malicious code or attempt to compromise system security
• Share account credentials with unauthorized users
• Use the Service for any commercial purpose outside of your childcare operations

4. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You acknowledge that you have read and understood our Privacy Policy, which explains how we collect, use, and protect your information.

5. Subscription and Payment

5.1 Subscription Plans

CentreWizard offers various subscription plans with different features and pricing. Current pricing is available on our website.

5.2 Payment Terms

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are in Australian Dollars (AUD) and include GST where applicable
• Payment is due immediately upon invoice
• Late payments may result in service suspension

5.3 Refunds and Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial months or unused portions of annual subscriptions
• We reserve the right to terminate accounts for violation of these Terms

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Bluegum Labs Pty Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance that temporarily affects service availability. We will provide reasonable notice of planned maintenance when possible.

8. Limitation of Liability

To the maximum extent permitted by Australian law, Bluegum Labs Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Compliance and Regulatory Requirements

While CentreWizard is designed to assist with NQF compliance and regulatory requirements, you remain responsible for ensuring your childcare centre meets all applicable laws, regulations, and standards. The Service is a tool to assist compliance but does not guarantee regulatory compliance.

10. Indemnification

You agree to defend, indemnify, and hold harmless Bluegum Labs Pty Ltd from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New South Wales.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
